These Terms & Conditions ("Terms") govern access to and use of the thefitnesss website and mobile application (together, the "Service"), operated by N2R Technologies LLP ("thefitnesss", "we", "us", "our"), a limited liability partnership based in Lucknow, India. By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
thefitnesss is a business-to-business tool intended for gym owners, managers and authorised staff ("Gym Account", "you"). You must be at least 18 years old and legally able to enter into a binding contract to create a Gym Account. If you use the Service on behalf of a business, you confirm you have the authority to bind that business to these Terms.
thefitnesss provides gym management tools including, but not limited to: member records, membership plans, QR-based attendance check-in/checkout, staff and shift scheduling, class scheduling, payment record-keeping, UPI QR display, and automated fee reminders via push notification, SMS and WhatsApp. Features may be added, changed or removed over time.

Access to thefitnesss is provided on a subscription basis as described at the time of sign-up. Unless stated otherwise:
All member, staff, attendance and payment data you enter into thefitnesss belongs to you as the gym owner/operator. We act as a data processor on your behalf for this data and will not use it for purposes other than providing and improving the Service, except as described in our Privacy Policy. On termination of your account, you may request an export of your data within the timeframe described in our Data Deletion policy.
You agree not to use the Service to:
The Service may rely on third-party providers for functions such as SMS/WhatsApp delivery, cloud hosting, and analytics. Their availability, pricing and terms may affect related features of the Service. We are not responsible for outages or changes caused by third-party providers, though we will make reasonable efforts to notify you of material changes.
The thefitnesss name, logo, app design and underlying software are the property of N2R Technologies LLP. Nothing in these Terms grants you rights to our intellectual property beyond the limited right to use the Service as intended.
The Service is provided "as is". While we work to keep attendance, payment and reminder features accurate and reliable, we do not guarantee uninterrupted or error-free operation, and we recommend maintaining your own backup records for critical financial data. To the extent permitted by law, our liability for any claim relating to the Service is limited to the subscription fees paid by you in the three months preceding the claim.
We may suspend or terminate access to the Service for breach of these Terms, non-payment, or suspected fraudulent or unlawful use. You may cancel your subscription at any time as described in our Refund & Cancellation Policy.
We may update these Terms from time to time. Material changes will be notified through the app or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Lucknow, Uttar Pradesh.
